In connection with the changes in the Public procurement law which are being discussed in the parliament, TI – Bulgaria proposed its legislative amendments. The proposals have been addressed directly to the 41st National Assembly’s chairman, to the chairmen of Legal Affairs, Economic Policy, Energy and Tourism, Regional Policy and Local Self-Government Committees and to the Committee on European Affairs and Oversight of the European Funds as well.
TI – Bulgaria proposes the status of the independent observer in procedures of public procurement to be regulated. Also TI – Bulgaria stresses on the need for creation of an additional transparency mechanism in the Administrative infringement law and in the Criminal code.
The proposals of TI – Bulgaria develop further the principles of transparency and publicity declared in art. 2 par. 1 of Public procurement law which are in conformity with the good practices in the EU. They are formulated on the basis of a long standing experience in this field which includes also the monitoring of the construction of Trakia highway.
In its standpoint to the National Assembly TI – Bulgaria gives arguments on the idea for inclusion of experts representatives of business organizations in the structures of the committees conducting the public procurement procedures. TI – Bulgaria thinks that the participation of business- representatives in the structures of the committees it’s a conflict of interests which hides the potential for corruption and/or for deforming and discrediting of the whole process on assignation and fulfillment of public procurement.
