Recommendation for the Public Procurement Law amendments

29.03.2011

TI-Bulgaria sent its recommendations reflecting on the workshops for amendments in the Public Procurement Law (PPL). The workshops were initiated by the minister for EU funds management Mr. Tomislav Donchev. The focal point of the recommendations is the suggestion for regulation of the status of the independent observer.

TI-Bulgaria’s recommendations for amendments are targeted mainly at development of functional mechanisms for adopting the principles of publicity and transparency, which are specifically declared in Art. 2 Para. 1 from PPL. In this regard, a very clear definition is presented of the status of the independent observer as an original guarantee to the society for the transparent execution of the PPL process.

TI-Bulgaria recommends the induction of new compositions for administrative and criminal liability of persons who have committed various breaches of the law.

A number of recommendations have been formulated aimed at increasing the transparency in disclosing the information regarding the tender and the prices that the bidders have given.
